These terms and conditions set out the terms of cooperation between the provider Nik Dimitrijevič s.p. (hereinafter: the provider) and the client of the services.
By submitting an inquiry, confirming a quote, or ordering a service, the client confirms that they have read and agree to these terms and conditions.
Collaboration begins with an inquiry via the contact form, email, or another agreed communication channel.
Based on the discussion, the provider prepares a quote covering the scope of services, estimated timeline, price and payment terms.
Work on the service begins once the quote is confirmed or the conditions set out in the quote are met.
Payment terms are set out in each individual quote or agreement.
Unless otherwise agreed, the following applies:
For services billed monthly, payment is made in advance, unless otherwise agreed.
As the provider is not a VAT payer, all prices listed are exclusive of VAT.
The estimated timeline is set out in the quote.
The timeline begins once the client provides all necessary information and materials and confirms the quote, or fulfills the agreed conditions for the service to begin.
If the client fails to provide the necessary information, text, photos or other materials on time, the timeline is extended accordingly.
If the client fails to provide the necessary information or materials for more than 30 days, the provider reserves the right to temporarily suspend or terminate the project. Any continuation of the project will be agreed separately.
If the client withdraws from the project after work has begun, the work already completed is billed proportionally based on the stage of completion.
Payments already made for completed work are non-refundable.
The client warrants that they have the necessary rights to use all text, photos, logos and other content they provide to the provider.
Once payment is made in full, the client acquires the right to use the completed project for the agreed purpose.
The provider reserves the right to use the completed project as a reference in their portfolio or when showcasing their work, unless otherwise agreed in writing.
The scope of any free support after project completion is set out in the quote or the chosen service package.
Any additional changes, upgrades or other work not included in the agreed scope of services will be billed according to the current price list or by prior agreement.
The provider is not liable for outages, errors or damage caused by the services or systems of third-party providers (e.g. the hosting provider, domain registrar, email provider, payment services, or other external services).
Likewise, the provider is not liable for data loss, security incidents, business damage, loss of revenue, or other indirect consequences arising from the actions of the client, third parties, or circumstances beyond the provider's control.
All relationships between the provider and the client are governed by the law of the Republic of Slovenia.
Any disputes will be resolved amicably. If an amicable resolution is not possible, the competent court in the Republic of Slovenia shall have jurisdiction.
The provider reserves the right to amend these terms and conditions.
Amended terms take effect on the date they are published on this website.
